SMS Terms of Service

These Terms of Service ("Terms") govern the SMS/text messaging program operated by United Counseling and Support Services, doing business as Mettle Works Behavioral Health ("Mettle Works," "we," "us," or "our"). By providing your mobile phone number and consenting to receive text messages, you agree to these Terms.
1. Program Description
By enrolling, you agree to receive transactional SMS text messages from Mettle Works Behavioral Health related to your participation in our programs. Messages may include:
- Appointment and session reminders
- Scheduling confirmations and updates
- Attendance follow-up communications
- Program enrollment notifications
- Other service-related communications
This is a transactional messaging program. We do not send marketing or promotional text messages.
2. Consent
You may provide consent to receive SMS messages during program intake or enrollment (verbally, with consent documented in your client record), by completing the Mettle Works SMS consent form, or through our program enrollment form. Consent to receive text messages is not required as a condition of receiving services. Consent may be revoked at any time (see Opt-Out below).
3. Message Frequency
Message frequency varies based on your scheduled appointments and program activities — typically 2 to 5 messages per week.
4. Message and Data Rates
Message and data rates may apply according to your wireless carrier plan. Mettle Works does not charge for SMS messages, but your carrier's standard messaging rates may apply. Check with your wireless carrier for details about your messaging plan.
5. Opt-Out
You may opt out of SMS messages at any time by replying STOP to any message. After you opt out, you will receive a one-time confirmation message, and no further messages will be sent unless you opt back in. You may re-subscribe by replying START or by contacting our office.

7. Privacy and Mobile Information
SMS message content does not include protected health information (PHI), clinical notes, or treatment details. Messages are limited to scheduling, attendance, and program logistics.
Mobile phone numbers and SMS opt-in information — including phone numbers and consent — will not be shared with, sold to, rented to, or disclosed to any third parties or affiliates for any purpose, including marketing. Text messaging originator opt-in data and consent are never shared with any third parties. This commitment remains in effect in the event of a business transfer.

8. Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above. Continued participation in the SMS program after changes become effective constitutes acceptance of the updated Terms.
